Terms of Service

These Terms of Service ("Terms") govern your access to and use of MARKA AI ("MARKA", "the Service"), operated by Akira Digital, a business registered in South Africa. By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not access the Service.

MARKA is an AI-powered marketing platform that provides South African small and medium businesses with access to specialist AI agents for social media, Google Ads, and website SEO. The Service is powered by Anthropic's Claude AI model.

MARKA is a tool to assist with marketing strategy and content creation. It does not replace professional legal, financial, or specialist marketing advice.

You must be at least 18 years old and operating a legitimate business to use MARKA. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You agree to provide accurate information when registering and to keep your account details up to date. Akira Digital reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

MARKA offers a free tier and paid subscription plans (Starter, Pro, and Business). Paid plans are billed monthly in South African Rand (ZAR) via PayFast.

Subscriptions renew automatically each month. You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period — no refunds are issued for partial months.

Akira Digital reserves the right to change pricing with 30 days' notice to registered users.

You agree not to use MARKA to:

• Generate content that is unlawful, defamatory, harassing, or fraudulent
• Violate any applicable South African law or regulation
• Infringe on the intellectual property rights of any third party
• Attempt to reverse-engineer, scrape, or disrupt the Service
• Resell or sublicense access to the Service without written permission

Akira Digital reserves the right to remove content or suspend accounts that violate these terms without prior notice.

MARKA uses artificial intelligence to generate marketing content and strategy suggestions. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable for your specific situation
• You are responsible for reviewing and approving all content before publishing or acting on it
• Akira Digital is not liable for any outcomes resulting from AI-generated content you choose to use
• Content generated through the Service belongs to you, subject to Anthropic's usage policies

The MARKA platform, including its design, code, branding, and underlying technology, is the property of Akira Digital. You may not copy, reproduce, or create derivative works from any part of the platform without written consent.

Content you submit to MARKA (your business profile, prompts, and uploaded material) remains your property. You grant Akira Digital a limited licence to process this content solely for the purpose of providing the Service.

To the maximum extent permitted by South African law, Akira Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the event giving rise to the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Akira Digital does not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

Akira Digital may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
